1. ACCEPTANCE & PARTIES

These Terms of Service ("Agreement") govern the use of the Birikim Yap mobile application ("Application") by users ("User"). By accessing the Application, you agree to these terms in full.

3. NON-FINANCIAL SERVICE DISCLAIMER

Birikim Yap is NOT a bank, payment institution, electronic money institution, investment firm, or portfolio management company.

It does not collect deposits, provide loans, process financial transactions, or connect directly to bank accounts.

Birikim Yap is a personal software tool designed for tracking, simulating, and visualizing budget data declared directly by the user.

4. FINANCIAL DECISION RESPONSIBILITY

Budget limits, analytics, and insights are generated via automated rules for informational purposes only.

Nothing in the app constitutes official investment advice or financial consultancy. Users retain sole responsibility for their financial decisions.

5. CALCULATIONS & ESTIMATES

Daily, weekly, and monthly spending limits are mathematical forecasts based on user inputs. They do not guarantee specific savings or financial outcomes.

6. USER-PROVIDED DATA ACCURACY

Users are responsible for the accuracy of their entered incomes, expenses, and savings goals. Incorrect inputs will affect calculated limits.

7. VOICE EXPENSE & SPEECH RECOGNITION

Voice recognition relies on iOS Speech Recognition services. Speech recognition may misinterpret figures or categories due to background noise. Users should review voice entries.

8. THIRD-PARTY DEPENDENCIES

To the extent permitted by applicable law, certain features rely on iOS, Siri, Apple speech recognition, Apple/Google Authentication, Firebase infrastructure running on Google Cloud infrastructure, and internet connectivity. Temporary third-party outages may affect service availability.

9. SERVICE CONTINUITY & MAINTENANCE

No absolute guarantee is given that the app will operate without interruption or errors, or remain unchanged indefinitely on every device model. Birikim Yap may carry out reasonable temporary interruptions for security updates or technical necessities.

10. DATA SYNCHRONISATION & BACKUP

Birikim Yap holds your data both in on-device storage and on Firebase infrastructure running on Google Cloud. Communication between the device and the cloud takes place over a secure connection (TLS), and Google Cloud's standard storage security applies on the cloud side; end-to-end encryption is not used. In case of device failure or loss of connectivity, data up to the last synchronisation is preserved.

11. INTELLECTUAL PROPERTY RIGHTS

Save for cases permitted by law, all copyright in the app's code, interface designs, logo, mascot artwork, graphics and original texts belongs to Birikim Yap. Unauthorised copying, reverse engineering or commercial use is prohibited.

12. MISUSE & ACCOUNT SECURITY

Manipulating the system, attempting to circumvent security measures, or using automated scraping/bot tools is prohibited. Use may be restricted in case of breach.

The user is responsible for the security of their own device and login credentials.

13. CHANGES TO THE TERMS AND THE APP

Birikim Yap may update these Terms of Use in order to improve the app's features or to comply with updated legislation. The current terms are published on the website and within the app.

14. GOVERNING LAW & STATUTORY RIGHTS

These Terms are governed by the laws of the Republic of Turkey.

STATUTORY RIGHTS RESERVED: Nothing in these Terms of Use shall be construed so as to exclude or restrict consumer rights that cannot be waived or limited under Consumer Protection Law no. 6502 and related legislation, or Birikim Yap's statutory obligations.

15. SEVERABILITY

If any provision of this Agreement is found invalid or unenforceable by a competent court, that provision shall be deemed severable and the remaining provisions shall continue in full force and effect.
